What
is the Electronic Waste Recycling Fee Law? When does it go into effect?
The new Electronic Waste Recycling Fee law requires us (the retailer) to collect
a fee when we sell certain video display devices to consumers, starting January
1, 2005. The consumer owes the fee on the purchase, but we must collect the fee
when we make a sale of a covered electronic device in a store, by mail order,
or over the Internet. The money collected from the fee will help pay for the safe
recycling of video display devices such as computer monitors and televisions,
which contain hazardous materials. Are
any sales exempt from the fee?
Yes. The fee does not apply when a customer
purchases a video display device that is any of the following:
Used and not
refurbished.
Part of a motor vehicle, as defined in Vehicle Code section
415, or a component part of a motor vehicle assembled by or for a vehicle manufacturer
or franchised dealer. This includes replacement parts for use in a motor vehicle.
Is contained within, or a part of a piece of industrial, commercial, or medical
equipment, including monitoring or control equipment.
Contained within a
clothes washer, clothes dryer, refrigerator, refrigerator and freezer, microwave
oven, conventional oven or range, dishwasher, room air conditioner, dehumidifier,
or air purifier.
In addition, the following CED sales are not subject to
the fee: Sales
for resale.
Sales of products we ship directly to a location outside
California, if the transaction is not subject to California sales or use tax.
If the consumer takes possession of the product in California, the fee applies.
How
much is the fee?
The fee ranges from $6.00 to $10.00 per CED sale. It
is based on the size of the video display, measured diagonally.
